QuickGix Terms and Conditions

Welcome to QuickGix. These Terms and Conditions ("Terms") govern your use of our mobile application, website, and services (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Services.
1. Introduction
QuickGix ("we," "our," "us") provides a platform that connects customers with service providers for various services. These Terms outline the rights and responsibilities of both customers and service providers using the QuickGix platform.
2. Eligibility
2.1 Age Requirement
- You must be at least 18 years old to use our Services. By using our Services, you represent and warrant that you are 18 years of age or older.
2.2 Account Registration
- To access certain features of our Services, you must create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
3. User Conduct
3.1 Prohibited Activities
- You agree not to:
- Violate any applicable laws or regulations.
- Use our Services for any unlawful or fraudulent purposes.
- Interfere with or disrupt the operation of our Services.
- Impersonate any person or entity or misrepresent your affiliation with any person or entity.
3.2 Service Providers
- Service providers must comply with all applicable laws and regulations, including obtaining any necessary licenses or permits. Service providers are responsible for the quality and safety of the services they provide.
4. Bookings and Payments
4.1 Booking Services
- Customers can book services through our platform. Service providers have the discretion to accept or decline bookings.
4.2 Payments
- Payments for services are processed through our secure payment system. Customers agree to pay the total amount for the services booked, including any applicable taxes and fees.
4.3 Cancellations and Refunds
- Our cancellation and refund policy is outlined in the QuickGix Refund Policy. Please review the policy for details on eligibility and the process for requesting refunds.
5. Privacy
- Our collection, use, and disclosure of personal information are governed by the QuickGix Privacy Policy. By using our Services, you consent to the practices described in the Privacy Policy.
6. GPS and Map Systems
- QuickGix uses GPS and map systems to connect customers to service providers. By using our Services, you consent to the collection and use of your location data to facilitate service delivery.
7. Customer Gigs and Bidding
- Customers can post gigs for service providers to bid on. This competitive system allows customers to choose service providers based on their preferences and budget. Service providers can create and manage their own accounts through a separate service provider app.
8. Intellectual Property
8.1 Ownership
- All content and materials on the QuickGix platform, including text, graphics, logos, and software, are the property of QuickGix or its licensors and are protected by intellectual property laws.
8.2 License
- QuickGix grants you a limited, non-exclusive, non-transferable, and revocable license to access and use our Services for personal, non-commercial purposes.
9. INDEMNITY AND LEGAL PROTECTION
This Indemnity and Legal Protection Policy (hereinafter referred to as the "Policy") is an integral part of QuickGix's Terms & Conditions. By using the QuickGix platform, users and service providers agree to be bound by this Policy.
QuickGix is a facilitator platform, providing a marketplace for users (clients) and service providers (freelancers, artisans, skilled and unskilled workers) to connect for services. QuickGix does not provide the services directly and is not responsible for the actual execution, quality, or safety of any services performed by providers.
This document outlines indemnity clauses, liability limitations, dispute resolution procedures, and protections for QuickGix, users, and providers.
9.1. Indemnity for QuickGix
General Indemnification Clause
By using QuickGix, both users and service providers agree to indemnify, defend, and hold harmless QuickGix, its affiliates, directors, employees, agents, and partners from and against any claims, damages, liabilities, losses, legal fees, penalties, and expenses arising from:
- Any injury, death, loss, or damage suffered by users or providers related to service engagements.
- Any fraud, misrepresentation, negligence, or willful misconduct by a service provider or user.
- Any failure to comply with QuickGix's terms, policies, and agreements.
- Any breach of contract between a user and a service provider.
9.2 No Employer-Employee Relationship
QuickGix does not employ service providers. Providers operate as independent contractors and assume full responsibility for their work. QuickGix is not liable for:
- Wages, benefits, or employment-related claims from service providers.
- Any tax obligations arising from a provider’s income earned via QuickGix.
10. Limitation of Liability
10.1 General Limitation
QuickGix, its affiliates, employees, agents, and directors shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages resulting from:
- Defective, incomplete, or poor-quality services provided by service providers.
- Any accidents, injuries, or property damage caused during service execution.
- Misconduct, fraud, or unprofessional behavior of service providers.
- Theft, loss, or destruction of personal or business property during a service engagement.
- Force majeure events such as natural disasters, strikes, government regulations, or unforeseen circumstances
11. User and Provider Obligations
11.1 User Responsibilities
- Users agree to exercise due diligence when hiring a service provider.
- Users must not leave valuable items unattended or allow unauthorized persons access to sensitive information.
- Users must review and confirm the provider’s credentials, experience, and past work before booking.
- Users acknowledge and accept risks associated with inviting service providers into their premises.
11.2 Provider Responsibilities
- Providers must complete services professionally and ethically.
- Providers must comply with safety standards and hold appropriate certifications (if applicable).
- Providers must not engage in fraudulent activities, theft, harassment, or misconduct.
- Providers agree that QuickGix is not responsible for damages or liabilities arising from their actions.
12. Dispute Resolution Process
QuickGix has a structured dispute resolution process to address claims between users and providers:
12.1 Filing a Complaint
- Users must file complaints within 24 hours after service completion.
- Complaints must be sent via the QuickGix app, website, or customer support hotline with clear evidence (photos, videos, or witness accounts).
12.2 Mediation and Resolution
- QuickGix will attempt to mediate between both parties.
- If mediation fails, QuickGix may offer:
✅ A refund (full/partial) to the user if service was incomplete
✅ A strike against the provider if at fault
✅ Service credit or discounts for affected users
12.3 Permanent Banning & Legal Actions
- 3 verified complaints against a provider = Permanent Ban
- Fraudulent claims by users = Account suspension
- Serious offenses (e.g., theft, harassment, assault) will be reported to law enforcement.
13. Trade Assurance & Service Guarantees
To ensure consumer protection, QuickGix offers:
13.1 Service Guarantee Policy
- Users are eligible for a refund or rebooking credit if:
✅ The service provider failed to show up
✅ The service was incomplete or substandard
✅ The provider violated QuickGix’s Code of Conduct
13.2 QuickGix Fraud Prevention System
- Background screening of providers.
- Ratings & reviews for users.
- Real-time GPS tracking for safety & transparency.
13.3 Provider Identity Verification & Username Consistency
To maintain the integrity, safety, and transparency of the QuickGix platform, all service providers are required to register using their true and verifiable identity.
a. Identity Requirements
By signing up as a provider, you agree to:

Submit a valid government-issued ID (Ghana Card/Driver's License/Passport) for verification purposes.

Ensure that your legal name matches the name used on your QuickGix profile unless you are registering as a licensed business.

Maintain accurate, up-to-date identity information at all times.
b. Username Policy (For Non-Business Providers)
If you are not a registered business entity, your QuickGix username must reflect your real, legal name as shown on your submitted identification. This helps build trust with users, promotes accountability, and supports platform-wide security.
QuickGix reserves the right to:

Decline or deactivate accounts with inconsistent or misleading identity information.

Request additional documentation at any time to verify authenticity.

Suspend provider access if identity discrepancies or fraudulent behavior are detected.
c. Registered Businesses
If you are registering on behalf of a licensed or incorporated business, your profile may reflect the official business name, but supporting documents such as a business registration certificate or business license must be uploaded in addition to your National ID verification.
14. Legal Compliance & Governing Law
This Policy shall be governed by and interpreted in accordance with the laws of Ghana.
- QuickGix is not responsible for legal disputes arising outside the platform.
- Any legal action against QuickGix must first go through mediation/arbitration.
15. Promotions & Rewards
This policy outlines the terms, structure, and execution of promotional campaigns on the QuickGix platform, including referral bonuses, discounts, coupons, wallet bonuses, and loyalty points. It is designed to maximize user acquisition and retention while protecting the interests of both service providers and the platform.
15.1. Scope

15.2 Types of Promotions
🔁 A. Refer & Earn

Users are given unique referral codes.

When a new user signs up and completes their first booking, the referring user earns GHS 5 credited to their wallet.
- Referee/new user receives GHC 20 as a welcome discount valid for 3 days to be used on first booking.

Referral earnings are non-withdrawable and can only be used for bookings (50% per booking max).

Referral earnings are funded by the platform whereas welcome discounts are funded by providers
🧾 B. Discounts & Coupons
Cost Sharing Model:
Providers may opt out of participating in platform-wide discount promotions via their dashboard settings.
💰 C. Wallet Bonuses & Loyalty Points
Loyalty Points:

Set by admin to reward users for booking frequency, spend threshold, or special milestones.

1 point = GHS 1, usable on future bookings.
Wallet Bonuses:

May be issued randomly to increase engagement (e.g., “Get GHS 10 bonus this week!”)

Wallet bonuses are fully funded by QuickGix and not charged to providers.

📌 Note: Providers can opt in or out of wallet-funded or promo bookings by declining such bookings. However, constistently opting out reduces visibility in high-traffic booking zones and promotional listings.
15.4 Fair Use & Abuse Prevention
To protect all parties:

Referral bonuses are only released after confirmed completed bookings

Multiple accounts linked to same phone/device/IP will be flagged and disqualified

Loyalty and wallet bonuses cannot be exchanged, transferred, or withdrawn

Abuse of discounts or promo loops may result in account restrictions
15.5 Platform Rights & Modification
QuickGix reserves the right to:

Adjust bonus amounts, discount values, or campaign durations without prior notice

Temporarily suspend promotions to evaluate system abuse or budget alignment

Terminate or reassign promotional mechanics based on performance analytics
15.6 Communication & Consent

By continuing to use QuickGix, all users and providers accept these promotional policies

16. Termination
- QuickGix reserves the right to terminate or suspend your account and access to our Services at any time, with or without cause, and with or without notice.
17. Changes to These Terms
- QuickGix may modify these Terms at any time. Any changes will be effective immediately upon posting the updated Terms on our website and app. Your continued use of our Services after the changes take effect constitutes your acceptance of the revised Terms.
18. Acceptance & Agreement
By using QuickGix, users and providers acknowledge and agree to this Indemnity and Legal Protection Policy.
